1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Raqmasar ("we," "us," or "our"), concerning your access to and use of the Raqmasar website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site" and the "Services"). You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Terms.
2. Description of Services
Raqmasar provides an online marketplace that connects users seeking to purchase professional services ("Clients") with users seeking to provide professional services ("Freelancers"). We provide tools to facilitate this connection, including user profiles, job postings, messaging, and a secure payment system.
3. User Eligibility and Registration
You must be at least 18 years of age to use the Services. By registering for an account, you represent and warrant that all information you submit is accurate and truthful and that you will maintain the accuracy of such information.
4. User Conduct and Responsibilities
You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services. Prohibited activity includes, but is not limited to:
- Posting any false, inaccurate, misleading, or defamatory content.
- Circumventing our fee structure, the billing process, or fees owed to Raqmasar.
- Attempting to communicate with or pay other users outside of the platform.
- Spamming, phishing, or distributing unsolicited commercial messages.
- Violating any intellectual property rights of others.
We reserve the right to suspend or terminate your account if you are found to be in violation of these terms.
5. Payments and Transactions
Clients agree to pay for the services they purchase, and Freelancers agree to deliver the services for which they are paid. Raqmasar facilitates payments through an escrow system, holding Client funds until work is approved. We charge service fees for use of the platform, which will be disclosed to you before you confirm a transaction.
6. Intellectual Property
Raqmasar retains all rights to its own content and the platform. Any work product, or "deliverables," created by a Freelancer for a Client remains the property of the Freelancer until payment is made in full. Upon full payment, the Freelancer grants the Client the rights to the delivered work as specified in their service agreement.
7. Disclaimers and Limitation of Liability
The Services are provided "as is" and "as available" without any warranties of any kind. We do not guarantee the quality, reliability, or legality of services provided by Freelancers.
To the fullest extent permitted by law, Raqmasar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Services.
8. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the updated terms on the Site and updating the "Last Updated" date.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of our jurisdiction, without regard to its conflict of law provisions.
